Today, I was told that if a minor is caught with weed/alcohol in their car, it is an automatic DWI, regardless of whether the driver was intoxicated or not. Is this true? If so, will I get 2 DWI's (1 for each substance)?
No, this is not true.

Do not believe what your friends tell you - they obviously do not know the law.

I went to an attorney yesterday, and he told me that there in fact IS a charge for paraphernalia, and it is a serious one that can put you in jail for 90 days? I'm really confused now...

There is a charge for paraphernalia, but not for MARIJUANA paraphernalia. If the attorney was referring to H&S 11364 and he believed it applied to marijuana paraphernalia, then he is not a good attorney to have for drug related charges.

Now, if we are talking about paraphernalia used to use hard drugs (cocaine, meth, heroin, ad nauseum, then that is another ballgame and IS covered under H&S 11364 and in the case of syringes, B&P 4140.

What CODE SECTIONS have been charged?
