We have a person who is a “guest” who we have decided they need to leave.

They do not sleep in the house, they do not own a set of keys to the house, nor do they have mail sent to the house.

I need to know if there is a legality behind someone who does not live within the living space.

Oh, and there is no binding contract in place for them either.

What is the name of your state? Washington State

Yes, long story short. They were only supposed to be there for days (verbatim) and they were going to find a place. Well, he is now sleeping in one of the vehicles of someone who does reside at the address.

We asked them 2 weeks ago to leave, they said they would, and have not respected our request. Now we are having to make a second attempt and mean business.

So, if the owner of the car does not lock his car and appears to be allowing him to stay in it, there may be a problem.

You can try calling the police concerning a trespasser, but, if he points to the person whose car he is in as granting him permission to be there, then he won't be trespassing.

Sounds like all the people in the house need to get on the same page with regards to how to deal with this.

I doubt that sleeping in a parked car constitutes being a tenant under the landlord tenant laws of your state.

Trespassing is not a likely issue if he is an invited guest of any resident ..the property owner can try to direct him not to trespass but I suspect police will duck it and call it a civil dispute .

I agree with above, people in house need to get on same page
