If it was a product worth under ~$100 they probably wouldn't go to far, but for over $1K they would probably go to court. It will be easier to let them have it back, then to lose in court. They will probably have an easy time proving 2 were delivered and a mistake was made. We're not talking about a toaster here. Enjoy it while you have it but do the right thing and contact them. Maybe they will sell it at a huge discount.
Fry's prosecutes all theft cases regardless of the amount. A co-workers son tried to steal a 75 cent candy bar. Not only did Fry's push for and get a criminal citation, they also tacked on a $125 civil penalty. The co-worker talked to the store security and was told Fry's has a zero tolerance policy when it comes to theft. I would bet this applies to the mail order side too.

The poster apparently didn't like the responses he got on the other board on which he posted. Oh, guess what, same ones here! (I'm tellin' ya, banging head smilie, NOW).

Besides, it's not just like they slipped the other TV in the mailbox or under the door mat without your knowledge.

Again, what would have been so difficult about "I didn't order two TVs. Put the other one back in the truck." You signed for 2 TVs when you KNEW you ordered only one. Forget how to count?

I think everyone is in agreement the 2nd TV should be returned.

Now, all you arm-chair lawyers ... it's time to start giving some SERIOUS legal advice (that wasn't asked for because the OP hadn't thought about this issue, yet) about how to actually go about returning the TV ... in a way that fully protects the OP from any further actions by Fry's.

How would YOU return the TV and MAKE DAMNED SURE that Fry's cannot charge you for anything whatsoever, not even any extra shipping, and cannot claim any debt, and cannot report anything on your credit report, and cannot sue you, and cannot charge you with a crime ... and cannot claim the TV was never returned even when it was (keeping in mind this is a business that is so disorganized and so incompetent, at least in the shipping department, that they would have shipped TWO TVs to the same person who ordered only one) ???
