Google "Texas <your county> eviction proceedings". That should get you started. Even if you hired an attorney to do this, it shouldn't cost more than $100 (maybe $200). MOVE ON THIS NOW, time's-a-wasting. EVICT and gain reentry to your home. If it's been abandoned, call the police and have them meet you there when you entry. They can verify the house is empty. Change the locks. Re-rent.

If the tenant has filed for bankruptcy, you may not contact him or go after him for what he owes you. Hopefully, he left the house in decent shape. Hopefully, you took a large non-refundable deposit.

If the tenant has not filed for bankruptcy, you may go after him for unpaid rent, but honestly, you messed up. You should have been trying to re-rent the house. I doubt that a judge will give you all you think you are out. You should have moved on the December of 2006 and your lawyer (the incompetitent one) should have explained this to you. You can sue him in small claims, then put a lien against his house for the judgement. I believe the limit for small claims in Texas is $10,000. (But again, I doubt that a judge would award you all of it because you have done nothing to try to re-rent the house.)

Have I mentioned your lawyer is incompetent (unless you are not telling us everything).

Linda - go look at Temple's other posts. This one is a train wreck. I doubt the lawyer is incompetent.

I Am In A World Of Hurt....

There is no question that I have become entangled in a terrible mess. Why else would I be HERE???? I am no expert! I am here because I am desperately needing help! You would think that if one is of the opinion that another is a "train wreck", that those who have the knowledge, and have voluntarily committed to assist those less fortunate than themselves, would strive to do so.

I know that the place I am in right now may seem quite unbelievable, as it still is, at times, even to me. Everything I have stated is unfortunately true.

Rather than poke run at someone's hardship, COULD ANY OF YOU PLEASE HELP ME!!!

Again, that is why I came here.

If I have not said it yet I thank you very much. You took the time not only to respond, but also you used your knowledge to truly try and assist someone else in great need, while expecting nothing in return.

If there is anything good that will come out of me having to get through all of this, it will be the fact that I am a MUCH more educated person in the areas of both bankruptcy and real estate law. I know that I have not learned enough though, because I am still in this mess all the way up to my chin! That's deep!

However, I was always raised to believe that the justice system in our country has its foundations in the honest, right and moral truths and will defend those values in defending the individuals that uphold the same. I admit, my life has been physically and emotionally turned upside down by all of this over the last two years and it seems to just keep coming....and it certainly does not help when your lawyer (WHEN he calls) keeps on telling you he has never witnessed nor heard of any other case quite this horrible!

It is hard to swallow my pride and admit that I was taken advantage of. But it is what is is and I KNOW that SOMEHOW there is a law, or former case, or statute, ANYTHING that WILL help me to get out of this with the courts on the side of the law and justice, my side.

I just have not found it yet, but i will not stop looking.
