i have a couple who are living in their trailer in my back yard with the agreement that they would pay $300.00 a month. well this will be the second month and rent was due on the first. :eek: they said they will pay it but they have not and they have been egnoring me, i have not seen them in 2 days. :mad: what can i do to get my rent? can i charge a late fee? or interest?if so how much? can i lock them out till they pay? if they move out can i hold their trailer for the rent that is owed? :confused:

i sure would appreciate if someone could help me with these questions :)

well, as i am new at this and they were friends of my daughter, there was no written lease. just a verbal agreement

**A: Ok, in that case, read the L/T law (CA Civil Codes) as it applies. And after you thoroughly read the applicable sections of the law, post back if you have specifc questions.

And in addition, what EXACTLY were all the terms of your verbal agreement... and how will you be able to prove them if needed in court???

While s8u3 sifts through CA code (don't laugh, it could happen), I'd like to point out a couple of things before he does something stupid.

1. You cannot lock these people out of their trailer. Period.

2. Owners of trailers are usually given more time to move out simply because moving a trailer isn't something that can be done without some planning.

3. Without a court order, you can't do anything with their trailer.

Sorry, Teri. :) Rather than assume you were a she based on the spelling of your name, I erred by using a masculine pronoun. Not only am I grammatically incorrect, I ventured into politically incorrectness. Shame on me ;)

Oops, just read your latest while previewing my post. It's great that you are going to write up an agreement; it will help with future problems. I'm sure you know you can't retroactively apply a newly written agreement to past violations. You'll have to enforce your verbal agreement with CA code which may or may not support that agreement.
