I want to thank the people who have given me some constructive advice. My only concern now is if i can get help due to me being low income.
Dude, if you can't afford an attorney, you're going to have to do this on your own. It can be done. The other thing you can check to see if there is a family law facilitator in your jurisdiction.

We have a poster named Proserpina who lives in your state. I'll ask her to come and see if she can offer you any specific advice pertinent to Washington.

Wow I would offer you some sort of help if i could offer it. It is nice to see that people still care for others and there is some compasion left in the world. Ive gone threw and read alot of other posts about individuals waiting so long before they do something. Im trying not to do that. But i would really appriciate any help from a poster who lives in this state. Im trying to make what money i have last. I am still supporting my children i buy diapers online and have it to where the mom can pick them up. Ive mailed more clothes. But my money is running out.

Pro is especially wonderful and smart in these matters. You may also talk to an attorney...Many offer free consults (10-30 min's). It is hard to do this on your own...BUT if you educate yourself you CAN do it. Many of the Sr. Members have done so.

Please do not be offended...But you want to be especially careful with spelling/punctuation/grammar. HOW you present yourself in filings is important. Judges are Human and can/may/will be prejudice based on your comments.

Additional idea - see if there's a local law school which might provide some assistance from students.

And when you file with the courts, request a fee waiver.

Read through the posts here, REALLY read through the forms on the court website, and any instructions provided there.

And to echo some previous advice: Watch the grammer/punctuation, etc. Your motions don't have to be in legalese, but they do have to be clear and understandable. If that is not your strength, get some help.
Have a friend read over your papers to make sure they are well-written.
Think of your legal paperwork as a final essay or term paper.

I want to give you some encouragement to file ASAP.

The WA courts don't usually want to release jurisdiction in cases where one parent just ups and leaves. You both went down to AZ on *vacation and while you returned , she and the kids didn't.

As the other seniors pointed out, file for custody. If your ex has not gotten a new driver's license in AZ, that is one piece of evidence you can use right away to prove she is a WA resident and the children should be returned to their home state.

Learned a few things from family in WA...

Be careful with this. If your friend is simply checking grammar and punctuation, you're OK. But as soon as they start telling you what to write, you have to be concerned about practicing law without a license. I don't know where the line is, but you want to be sure not to cross it.

Absolutely. I have been asked by a judge in civil court if I produced my own petitions and motions. You need to be able to honestly answer yes to that question if asked. A lawyer or paralegal can help you, but if they actually produce the document the court must be aware of that.

Thank you guys so much, Im working on alot of differnt things. I dont qualify for legal help because i gross 27.12 over the poverty limit for a one person familly. Alot of what i have learned has been threw links provided, and what ive been able to find on my own. I've been told the mother has obtained a AZ Id card. As stated before though The only reason my children left the state in the first place was on the notion that we would be returning home.

I'm not sure how recently your family has dealt with things in WA, but your post isn't quite "on".

Dad, CSO and the others have given you some great advice and the link to the forms in WA. I'm not too sure what else I can add :)

I will say that the trend is in favor of relocation these days. You may well find yourself having to prove why Mom shouldn't be allowed to move with the kids and WA might have no problem at all relinquishing jurisdiction even if Mom did the wrong thing by not going through the court. You need to articulate why the children should remain in WA - how much time you've spent with the kids, how much support you have here, everything.

You MUST of course file immediately in WA. The longer she's there, the less likely it is what WA will force her to return the children.

Other than that, you're going to have to play the waiting game.
