Indiana CHINS REVIEW HEARING TOMORROW

I have a court order in place due to a CHINS case. I started using fentanyl occasionally (was supposed to be Xanax)—-in February/March of this year. I was court ordered after multiple failed screens, and my daughter being placed with my mother-that I attend inpatient rehab followed by transitional housing. This order was a few weeks ago. I went to a rehab facility, but after detox-they medically discharged me last Tuesday due to Covid symptoms. They said they would write a letter to the judge stating it wasn’t my choice to leave, and I was sent home. They sent an order to quarantine for 14 days and to return to inpatient if I was still seeking treatment-and that I would need to supply a negative COVID test. I scheduled one as soon as I got home, for last Friday. Fast forward to Thursday evening, my van blows a head. I have it taken to park at my mom’s house. Since then, I’ve had no vehicle to drive. The court and dcs teams were persistent that I be quarantine and that they would not be able to offer assistance with transportation to get screened. It’s Monday now, and I’m worried about tomorrow’s review hearing. I’m sober/clean. I have no urges or cravings to “use”...And my plan for tomorrow was to sign temporary guardianship to my mother-because she has expressed she is tired of dealing with DCS daily. She’s the Vice President of her company and she’s juggling work, my younger siblings, as well as my 6 month old daughter..She told me that I have a month to prove to her that I can get a job/secure housing etc....But she called me tonight in tears, saying that DCS had told her the recommendation tomorrow in court will be for incarceration. 30 days. For not following the court order. I have the discharge paperwork from rehab, saying I was not leaving AMA. I was told to quarantine for 14 days, and to return. What is my move?

Were you breast feeding while you were "occasionally" using fentanyl?

ETA: I see you were actually using fentanyl while in the late stages of your pregnancy. Was the baby born addicted? Why were you on Xanax while pregnant?

Fentanyl is a far cry from Xanax. The Indiana CHINS is a real morass. It is going to take an attorney with specific experience to help you. There have been some Constitutional challenges but your description fo the situation doesn't bode well for you.

correction: my baby is was born Feb 14th,

i started using a couple weeks after she was born. She was not exposed to fentanyl. she was checked at the hospital right after removal.

They came in because of a report that we brought our baby home to a “trap house”, and her father had a rico case built against him a few years back. So his name is big drug money. We split up. But when DCS came in after my daughter was 6 weeks old, they took her due to fentanyl being in my system an the risks of contamination. I went to rehab, but I started testing positive for thc habitually afterwards. They wanted to send me back to rehab for marijuana. Being medically discharged last week, I haven't used ANY substances. I‘ve obtained a job that I start friday, unless I’m in jail. I am purchasing a new vehicle tomorrow, providing the same.

So you have only been clean for basically a week. You risk incarceration for criminal contempt? You should have counsel quite frankly. Do you? If not, ask the court to appoint you counsel. Did you have a trial where they proved the child was in need of services? Or did you agree?

I'm a bit confused... You were supposed to return to IP rehab after quarantine... How does that work if you plan to start a new job this week? In terms of the screening/COVID test - is there no Uber/Lyft in your area to get you there?

You seriously need a lawyer.

Court went well. I am going back to inpatient rehab and I have a month before they appoint guardianship to my mom. They’re giving custody back to me as long as I prove progress has been made. Thank you all!

You mean you waited for the night before court to seek assistance for such an important issue?

You are a mother...start taking that responsibility seriously.
