An inheritance received during marriage is not community property. However, there may be events that happen after it has been received that would change the nature of the funds.

EDIT: To be clear - if property is not "community property" then it is separate property. In a divorce, a spouse is not entitled to the separate property of the other spouse.

No. You don't get any immediate interest in property your wife inherits under the probate laws of any state. Is she living in Texas, too? If not, in what state does she reside? That's important because state law defines property rights. Texas is one of nine states that use a community property system for married couples, the rest of the states use the common law system for property rights. It also matters because each state has different divorce laws and different probate laws. It's possible that at some you might get an interest in the property she inherited, but a lot more details would be needed to figure that out. You ought to discuss this with a Texas property law attorney if she's in Texas and lay out all the details to see what you might have a claim to, either now or in the future.
