Okay then explain to me this.. how can someone else agree to terms of a legally binding contract without me knowing and agreeing to those terms myself?
Myriad courts throughout the land have found things such as those "click-through" licenses are valid. Same as the use of the software indicates agreement to the license terms if there is a warning of such. You agreed when you took the action. You should not have taken the action if you were unaware of what you agreed to.

That does not mean I agree with the law, just that it is the law.
