Class Action

So the attorney is thinking about a class action suit and I will know more next Tuesday. My question is will a class action benefit me more verses a private law suit? In reading this thread, there were some comments that scared me https://forum.freeadvice.com/civil-litigation-46/questionable-retainer-agreement-law-firm-class-action-lawsuit-606668-p2.html. It's a little different than the pros and cons weighed out here: https://law.freeadvice.com/litigation/class_actions/class-action-vs-private-lawsuit.htm. One of my bigger concerns is that we were hoping to refinance by the end of the year, possibly using the HARP program because the housing bubble put us underwater pretty badly. I'm showing our home is worth around $35,000 less via Redfin than what is was appraised for in 2008. With any refinance program, I'm pretty sure that if you're currently paying PMI, then you get stuck with again with the refinance. We're also looking at a Homestyle renovation refinance so that we can renovate our home to make it as energy efficient as possible with some cosmetic upgrades as well. Our retirement plan is purchasing an RV and traveling the U.S. while we rent this home out either keeping it as an investment or eventually re-selling it later on and purchasing something even smaller further south. We're trying to be as conservative and frugal as possible in our choices.

I'm going to Google more but if the attorney comes back with he wants to file the class action, are there any questions that anyone advise that I ask?

Also, I thought I would share this as I predicted there are going to be many lawsuits like this to come: http://www.realestateclassactions.com/2016/02/hamp-loans-dont-forget-about-federal-pmi-law/

Thanks in advance.

Well I think I screwed up any case I think that I might have had...

Apparently my complaint with the CFPB was still open and I got a response back from a paralegal about the PMI with wrong dates yet again. So I asked her if she was familiar with Rice vs. Greentree Servicing and the next thing that I know, I got a letter from them stating that my PMI had terminated. This is actually not a bad deal but I still need to see if I can recoup unearned premiums.

I let the attorney know that I screwed up and he probably wants to ring my neck. I've not heard back from him yet but do any of you think I still might have a case considering violated the HPA even if they are technically no longer violating?
