The city where we live has a municipal code that prevents two public streets from being connected via a private road. A private road must be a dead-end or a loop. The city’s transportation manager has approved a one-time variance to waive the code which will allow a developer to subdivide one of the lots. The city gets a small section of public road built and more revenue. Those of us that live along the private road are very upset since we will now get public traffic over our private road that is too narrow, has no curbs, has no sidewalks, and has no streetlights. A number of our neighbors want to hire an attorney to fight this and another group agrees that it is not right but think it would be throwing money away since the city always seems to get their way. Is it possible to successfully sue a city or a city employee over an inappropriate variance?
