when we apply for a marriage liscense here in Michigan and they ask for previous marriages, divorces etc. do we not mention the vegas deal, as I do have the same last name as him?? Any thoughts on that aspect?? :confused:

I would just state that you are remarrying.

Well... since the wedding in Vegas was void and not recognized by the state of Nevada, it certainly wouldn't be recognized by the state of Michigan.

When applying for your marriage license and knowingly swear to a false statement (ie. We're just getting remarried.) would be perjury under Michigan law.

Likewise, your "husband" by Nevada statute (Section 201) could face bigamy charges, a felony carrying a minimum of 1-4 years in prison and a fine of up to $5000 (NRS section 193.030).

Technically, you and he are single people, so get your marriage license as two single individuals.

Perhaps the two of you can discuss this with an attorney who can guide you through the legal aspects of the void Nevada marriage and your valid Michigan marriage.

OP would not need to explain to the MI folks issuing the license.

Or just tell them you are both from Arkansas---people in Michigan will understand

That would certainly simplify things.

To complicate things, the OP and boyfriend might want to discuss "pre-marital" assets and if in the unforeseen possibility of a future split, they would have a clear understanding of the assets they acquired during the period after the Nevada incident.

A little prenuptial planning could save a lot of headaches in the future.
