Sorry if I wasn't clear she wants me to move the child support hearing to FL since that is where we live and in fact haven't lived in NY for over 2 yrs. Fl is where the new statute is according to her. She brought it up because I mentioned how I am aware they do not take his fiances income and such into the equation, I understand that its not her kid, she stated that isn't the case here anymore.
She stated he is underpaying based on how FL does it in comparison to NY. She asked me if I knew what he is making and I don't anymore I knew what he was making when we went to court and she asked me how much it was I told her and looking over my paperwork she asked me who the other people I listed as he is living with and I told her it was his fiance and her 2 kids. This is when she stated the new statute I mentioned. She was shocked that the Department of revenue down here (I receive food stamps) did not discuss with me this to get it corrected. I am assuming because then I wouldn't have a need for the amount I receive.

She's not getting it (or someone, somewhere isn't).

You can't just switch forums because you'll get more money in State B than you would in State A where the original order is from.

That's just not how it works.

See, the CS will stay in NY because that's where Dad lives. I would suggest that you find an attorney that has ½-a-clue about interstate CS cases. :cool:

Just to be clear I honestly have no interest in changing what state has the CS order...I was just stating what the lawyer told me. I honestly think it would be stupid of me to mess with the child support because number one if FL did give me more he has stated numerous times if his child support goes up then he will quit, he will not pay anymore, and also like you guys are saying what she said about the statute doesn't make sense to me it is his kid not his fiances she has no responsibility to chip in and pay so how could they take that into account.
This isn't a matter of me just trying to get more money my priority is getting a visitation plan in place and getting my daughter to be able to see her father, that is it.
