My response:

This is not the issue. The issue was, and remains, why Jewish Holidays are not paid holidays, as opposed to certain other holidays. We all know that employers are not required to give Federal Holiday days off; especially in emergency services; e.g., police, fire, hospitals, etc. Again, however, that was not the issue in the original post.

The PRIMARY issue was whether an employer should require an employee to use PTO time in order to take a non-Federal Holiday, and why should an employer pay for other holidays; e.g., Federal Holidays, not requiring PTO time being used by the employee. That was the issue.

So, IF an employer gives its employees a Federal Holiday off, then that holiday is PAID by the employer. Jewish Holidays are not Federally mandated.

Whoa, hold your horses, there, big guy. You're mixing apples and oranges.

Although I disagree with you that the law requires an employer to pay an employee for Federal holidays (unless, of course, they are a Federal employee) I was explaining to him why an employer does not have to OFFER holidays. He was under the incorrect assumption that all employees, private and public, were mandated to have all Federal holidays off. I realize that was not the primary question, but it's applicable.
