I bought a house in Nevada with an associate, we are co-owners, and I am completely unfamiliar with real estate law. We both put a substantial equal down payment totalling 1/3 of the total cost.

Now, the other party can no longer pay their share of the mortgage payments. I can handle the full payment, but I dont want to continue paying unless the payments can somehow count toward my "share" of the house. Or, is there a legal way to get the non-payers name off the title?

I hope I am not forced to sell, but if so is there any type of contact that could have prevented this, two separate mortgages, etc?

What about preventing that in the future, there are no cotenancy contracts that force separate payments from the individuals?

**A: an attorney could draft a partnership agreement etc.

Can you give me some basic advice on what type of binding agreement? And how would it be enforced?
