Dad responded to FOC's request for payment. He said:
"These expenses have already been paid by me. Please note that I have also paid for my son's health insurance premium and have not been reimbursed for it."

That is not true. Is the burden of proof on him to show he did in fact pay me for his share? Otherwise, I'm not sure what I can prove in our hearing that has been scheduled as a result of his response. Secondly, how can someone bold face lie about this? Is there not a consequence from the court for saying that when it's not true?

Our orders do not require that he be reimbursed for the health care insurance premium (COBRA) that he's chosen to carry.


Also, our hearing will be in front of a referee. Is everything that is said recorded, even if it's not relevant to the case at hand? I ask because I am worried he is going to get our son his drivers license in a few months, despite my telling him I do not agree to him having one. I am wondering if I find a way to bring this up at the hearing will it then preclude him from being able to say he was not aware of my wishes. *I'm dealing with a lying liar who lies and trying to protect my son and myself.
If he has "paid" for it, kindly have him show his cancelled checks and proof of payment.

Ask that he show proof of these bills paid by him, at the Ref hearing. Who is ordered to carry the medical insurance? One can only be required to carry medical insurance if they have it available and if it meets a certain percentage of income. Read the child support formula manual it explains this far clearer then I can. If the Ref does not make him show proof and rules in his favor, well you can file an objection and hope a Judge will actually look at evidence instead of just taking his word.

Medical insurance premiums are not handled like the medical expenses. They are figured into the child support formula, so they are not done the same. Again you can find an explanation in the child support formula manual. You need to read it and understand it before going to the hearing. Often Refs don't do what they are suppose, specially if one does not know what a Ref is suppose to do and does not speak up at the hearing.

Technically the driver license thing, has nothing to do with this hearing, so a Ref does not have to listen to it. Drivers license and you 2 not agreeing on it, would fall under joint legal, not child support. He has not gotten him the drivers license yet, have you discussed this with him already and expressed your reasons? If so do you have this in an email?
