Hey CJANE I am insulted by this. I am not a low rent attorney and I have been known to charge less than this depending on the case. Thanks a lot. And I even answered your question.
Certainly did not mean to offend. Around here, $100/hour wouldn't get me an attorney at all. Mine is a pretty cheap attorney, and she's cutting me a break and it's $200/hour. My ex is paying his $400/hour.

JESUS H. CHRIST people...the answer is simple.

CJ, tell the ex to open an escrow account and place in this account the normal (or agreed to) support each month until the order is issued. Then, whether the order is retroactive to the date of filing or another date, the monies will be available and the state will not be able to double-bill him.
We'd discussed this too, and it has the $ available for the retroactive amount... but it's not getting me paid, which is the goal.

Seems like the system is just set up to screw people if he can't pay me without being penalized, and I can't collect until the state chooses to issue an order... grrrr.

getting you paid is not the point. Until the order is issued you don't get paid.

that's why the ncp NEVER should pay without the order being issued.

you said previously that you didnt have any expenses at all related to the baby yet, so why do you even need to get paid?

Two reasons:

1) The baby can't come to work with me forever, so there will be expenses related to the child - perhaps before the state issues an order. (though I'll know for sure when the caseworker calls me back)

2) He called me today and asked me to find out if there was any way he could pay me without it being considered a gift. He'd been given some advice, I called CSE for some info, and thought I'd try here. If he's willing and able to pay, who am I to say no?

BB ~ I know the objective isn't for me to get the money before there's an order. That's why I'm asking questions here before I just let him hand me a check. I don't want him ending up on the short end of this one.
