What is the name of your state (only U.S. law)? NY

Hi, I was arrested of a serious offense at the age of 15 in Nassau County, NY. I honestly don't remember what it was plead down to, but it is now almost 20 years later and I am looking into applying for a pistol permit but am trying to dig up info on the record to see if it was expunged or if it was just sealed. I am getting my record reviewed (unsupressed) by NYS (fingerprints taken) to check this. My two questions are:

1. Will this process show me details of the case if it was sealed, and if it was expunged I am assuming it won't show up at all.

2. If it was just sealed, is there a way to ask for it to be expunged?

Just trying to get my 'ducks' in a row before submitting the application. If it isn't or can't be expunged, not a big deal- I just won't bother applying.

I find it hard to understand that you don't "remember" what your conviction was. What was the "serious offence"?

As BlueMeanie is beginning to alude, there are certain offenses in New York that if you are over 12 when you commit aren't sealable/expungeable. Other delinquencies are sealable, but it's not automatic. If you are now an adult (have turned 18), then your best bet would be to talk to a lawyer. He can help you pull your record and if the history is sealable make the appropriate application.

Lol when I say I forget, it's because it was serious, but there was a lot of negotiations in terms of plea deals. So I don't remember the exact charges I actually plead down to.

Menacing was original. It was plead down to low class misdemeanor or violation, I just don't remember exactly
You should have all the documentation from the court with the disposition. Most people would think that was important enough to keep.

I suggest getting in touch with the New York State Division of Criminal Justice Services to get a copy of your criminal history. Check their website for information.

Parents are deceased and I was 15 so of course I don't have the ppwk. That's why I'm going through the fingerprint process and going to the courts. It was a gun (unloaded) no victim just was seen with it.

I'm going through the process of collecting whatever the state has, will get the cert of disposition but I guess my two questions still are:

1. Will the unsurpressed form that I will receive definitely have everything excluding expunged records? Meaning that if it is not listed, I can be certain that it was wiped?

2. Due to the age at the time of incident, would that POSSIBLY qualify for expungement in NYS?

I know there are several varying factors so if it's unknown, that's fine. I will wait and speak to a lawyer if needed. Just figured I would ask here in case anyone had prior experience or knowledge with this.

Okay. So now we know you illegally had a gun. Yeah...I'm gonna guess you will not be able to get a permit to own a firearm.

Again- I'm not saying you're wrong. However IF it was expunged then I'm fine. But IF it WASN'T expunged, is there a way in NYS due to the age to ask that it be wiped?
