Hey ppl; this has gone a little out of hand, can't we all just get along?

Quincy: Many thanks for your honest; but most of all; sensitive responses.

Everyone else: The OP just realised his working life might get a heck of a lot harder; some sensitivity is I feel at least required! Yes, it it true; "If you think this fact is harsh, then go take your angst out on the folks that make the laws. "; but if you went to doctor and found you were seriously ill would you prefer "Youre gonna die; sorry" or a more delicate approach?

I realise Im gonna get totally flamed for this; but I think a lot of posters have an AWFUL lot of legal knowledge but perhaps not the same amount of patience or diplomacy!

(PS: No, I'm not trying to turn this into a `pity-parade`. I just think some people have gotta remember, in some cases, its people whole working life at stake here!)

For the record, I hate Dr Phil. And being a Legal "Forum" means your going to have to deal with "people", who are ignorant of the law, maybe brushing up on your people skills isn't a bad idea. I can deal with; "Sorry pal, your screwed, the law says they don't have to give you a job or keep you on." Instead I got, "What's so special about you?" "Why so they keep you?" I may not be quoting exactly but that's the jist of it, with others following suit. Why not take a little time and realize your talking to people.

This is a bad economy; people are losing jobs left and right; people with perfectly clean records and many years of experience are having trouble finding and keeping jobs.

So, what IS so special about you that you should be able to keep your job when others are losing theirs? You thought it was an insult - I thought it was a perfectly reasonable question. If you've got an answer for it, then maybe we can provide you with some legal backing to support your position. If you don't have an answer for it, then I guess that's why you've been complaining about everyone's "harsh" answers.

I understand it's a bad economy, I'm from Michigan... we have the highest unemployment rate in the country where I live. The thing is I'm not being downsized, the job I do isn't being cut, as a matter of fact there are two postings for positions in my division right now, my job being one of them.

As to what's so special about me, for one I'm the first one in all of my family to go to college, (though only a local college) I'm the only son of a family of three girls, my parents divorced when I was two and although my dad had visitation every weekend he moved to Tx when I was seven to seek employment, (I went 16 years without hearing from or seeing him) I was raised mostly by my mother untill I was about 9-10 when my step-father and mother where married (he's a navy seal) and we spent the next 3-5 yrs jumping from place to place, being stationed several different places. Next 10-12 years where pretty normal until I met my now wife, we had 4 beautiful chilldren, one older son, twins; one boy - one girl and and little girl that thinks she's a teenager, and struggled pretty bad until the last 5-6 years. Worked for my dad for most of my adult life and was pretty happy to do so until about 3 1/2 years ago... economy was just starting to get bad and being a family owned company we where feeling it pretty hard, I was actually sent to my parents house to mow the lawn.... so I would have something to do to get paid for being hours where pretty scarce, when I got a call from the temp agency, which to me was odd being I hadn't worked for them in over 2 yrs. And that's how I started working for the hospital, in the beginning just doing what everyone else did, transporting blood, and other specimins to and from local doctors. The job I do now didn't exsist before me and wouldn't exsist except for me. I did all of the foot work, talked to all of the potential pick-ups set up the entire route, developed a working relationship with every doctor, every nurse, every person that I may or may not come in contact with during the couse of the day knows me, and knows that if there's a problem they don't call my boss they call me. No other driver/courier in the hospital can say that, not even my boss. I am the most reliable, dependible, and trustworthy person in the entire division. And I say that not because I believe that but because I've been told that by enough people to KNOW it. When another driver misses a pick-up, I'm the one that gets a call when something has to absolutely has to get done, I'm the one they call (between 8 am and 5 pm). And I work for my family, you may say that's what I'm supposed to do and that's true, but if you where to drive by my house you would know what's important to me, my kids, my wife, and my home. In that order. I put myself last in everything, and a lot of people SAY that but don't actually follow it, I don't drink, I don't smoke, I don't run around the bars. All in all there's really nothing spectacular about me but as far as my job is conscerned I can honestly say there's no one that can do what I do. And I'm not tooting my own horn (in a way yes I am but only by proxy) I just know what I know. Most of all I'm a person and should be treated as such. I've done enough rambeling (sp) and truthfully I'm not special, I just do what I'm supposed to do, and I think in these times that's what makes me special.

You answered cbg's question nicely, Griffzan, and outlined your strengths well.

Cbg is a Human Resource expert, so wait for her to post back with advice, but I have a non-legal suggestion that you may wish to consider.

I suggest that you get letters of recommendations from those with whom you have worked, those who have noticed and commented on your reliability and your abilities. These letters can help you when you are trying to secure employment elsewhere.

Michigan's economy is definitely bad, but the health field is still one that is seeking workers of all types. If you are able to commute, you could even find another position as courier/driver at another hospital or clinic.

You should be honest on all job applications, but employment applications are where you NEED to toot your own horn, so provide details of your temporary work and what you have accomplished as driver/courier. You should be prepared for rejections because, for every application you fill out, there will be many many many other individuals competing for the same position. Most of these applicants will be conviction-free, but most will also not have your prior work experience and work ethic.

Okay, that explains why you consider yourself a good employee, and I don't disagree with you. It sounds as if you are.

Unfortunately, nothing you have posted provides a legal reason why the hospital should be prohibited from firing you, and does not give you a legal reason to fight their decision.

It should, however, be a good reason for you to be hired somewhere else. I think quincy has outlined how to go about this as well as I could, so follow his advice.
