Years ago I had a LL who set the rent at (just as an example), $850 and it was due on the 5th, but he allowed a $50 discount if rent was paid before the 5th. He was avoiding charging a late fee so that he wouldn't have a problem if he ever had to go to court.

Yes he can start the eviction process at the first day he's late, but there's a ten-day grace (there's that word again) period from when the notice is served on the tenant that the tenant can pay what is owed and stop it.

Of course, a chronically late tenant is ripe for not having his lease renewed.
