Around WA state I've seen late charges of $75.00. I feel a small daily charge is much more fair. It's true that on the 5th, I've gotten $15 in late fees, that's about all I get, because if the tenant has not paid by the 5th they have a pay or move notice. They pay or move! I also explain if they want me to wait 5 days, bring me 5 days rent and I'll wait.

You said the late fees like this were illegal in CA and someone else said it can't start until the 5th.

Now, I don't know if CA did away with late fee law or not since I don't live there. I'll have to accept that as a landlord in CA you should know law. Or do you?

Pull up this Northern California site http://www.bpoa.org click on forms and then click on rental agreement # 2, look down at paragraph 9 where is said a late fee of $10.00 per day starts on the second day.

I'm not trying to be a wise one, but are they illegal, or don't you know your state law.
