If you loan your car to someone who then causes an accident, both you AND the driver are potentially liable. If the son was driving, it would be pretty clear that he was liable; the involvement of the child just makes it a little more complicated.

heck, it today's society, both the 35 yo kid and the 6 yo's parents should feel lucky they are not charged with endangering the welfare of the child.

basic bottom line: most likely the 35 yo is liable for his lack of securing the cart in such a manner it could not be easily overcome by the 6 yo child he left in the cart. His control of the vehicle and his control of the child (or lack of actually) are the cause of the damage. Others could be drug in but most likely it is the 35 yo guys fault.

I sent a certified letter to the owner of the golf cart with two seperate repair quotes.I simpoly stated that I intended to pursue legal action if I was not compensated for the damages . The next week he came by and wrote a check. Amazing what a little documentation will do . I'm still a little upset I had to go to legal threats to get him to do the right thing.
I guess I should be happy with the check and move on.
