File suit in his home State and then when the court date is due take the family on a vacation to Chicago. You should win, so you will end up getting a cheaper vacation!

I just can't believe that there's really nothing I can do with all the proof in the world that the recipient kept the merchandise, after receiving their money back.
The problem is that you do not have any proof of that. You have proof that someone at address QWERT, claiming to be person ABC, received the package you sent. You also have proof that person XYZ, whose account you charged $800, claimed that they did not authorize the charge and have since received their money back. You do not have any proof that the person ABC is the same person as person XYZ or that person XYZ actually authorized the purchase.

Sending to an unconfirmed address should have been a red flag. Here's what most probably happened. A person hacks into an account using phishing r some other means, changes the mailing address (now an unconfirmed address), buys a bunch of stuff that is shipped to the new address. By the time the owner sees the charge, the criminal is long gone and you are the one left holding the (empty) bag. Consider this a lesson learnt and move on.

First post! Here is my situation:

I sold three car navigation systems on eBay; two of which, the transactions completed flawlessly. The third, however, did not. It was shipped to an unconfirmed PayPal address (basically means that PayPal would not block a chargeback, in case one was invoked by the buyer; exactly what happened in this case). The buyer had 100% positive feedback and approximately 40 purchases, so I thought he was somewhat trustworthy and I've never had problems in the past; nor did I realize that an uncomfirmed account meant that there was no protection. The item was insured and signature confirmation was used for the shipment. Shortly after I shipped, the buyer filed a chargeback, indicating "Unauthorized Payment." This was in October 2008 and I have officially lost the case, as of a couple of days ago (PayPal "fought" on my behalf until this point). I provided proof of delivery, proof that I have a 100% positive feedback account(400+), and made note of my "Premier" PayPal account status. I filed a claim with the IC3 (Internet Crime Complaint Center (IC3) | Home), but it doesn't seem that anything will come to fruition from that. Does anyone else have any other recommendations for action that I can take to reclaim the item or funds? I have all of the buyer's information, proof of shipment, etc. Interestingly, PayPal changed their policies a couple of weeks after the buyer filed this case, in which I would have been covered with protection from PayPal in this situation.

My heart goes out to you. I've been ripped off many times with Paypal. In the future, state in your eBay auction that you will only ship to confirmed addresses. This way if something goes wrong, you'll be covered.

I think someone mentioned before, it might be worth suing the person. You have proof he won and purchased the item and you have proof that it was sent and that he received it. Call up a lawyer and see what he/she tells you.

Can you please enlighten the rest of us by telling us how has proof of any of that. It has to include actual proof that the person who was charged the money is actually the person that received the merchandise.
