Don't count on a lump sum. Many times the party is not paying because of a temporary financial crisis. It's not necessarilly that he'd have that money sitting somewhere simply because he didn't send it to you. For all you know, he could be lying in a coma in some hospital following an accident!

Yes, you will be entitled to get the amount owed to you, but a lump sume payment can only occur if he has access to funds sufficient to pay a lump sum. Else he'll just pay it out over time.
