My question is how much weight does family member statements have?
with you having a lawyer, opposing family satements should all be reguarded as hear-say.
Opposing family statements are not hearsay. The judge decides the weight and credibility of any conflicting testimony, and what evidence to accept or reject. While there is an equal inference rule with regards to purely circumstantial evidence, it is not always applied as it should be.
 


Back to court we all went again! I asked for a dismissal but it was denied figures then for a continuance to retain the attorney again, he couldn't be there yesterday. She is bringing up things that I did at my former employer even subpeona them. But it has not one thing to do with domestic violence or any violence at all. I don't get it?!? I am no judge, lawyer or really know anything about law really but how does this all fit into a restraining order against me to protect her??? How would a judge allow it in? The only thing I can even remotely think it would matter is my character or credibility. Help me out here people I am confused???

Presumably if the judge does let such things in it's because it does reflect on your character.

Past actions, etc., etc.
 
How do I subpoena a police officer in the state of Washington? Do I use a regular subpoena or a subpoena duces tecum? And what is the process or would a court clerk be able to walk be through it since I am not the petitioner in the R/O?
 
And it looks like I am gonna be doing this on my own without retaining an attorney because I just can't afford another go around. :mad:

The Mass RO process is NOT the same as WA. The link provided to you is useless in your state.
You would do well to NOT listen to outhouse. His/Her advice is as accurate as..well...the contents of a outhouse.
 
I did see that some of the things on the website differ a little bit but not by alot. But thank you for pointing that out because I do know that laws are different from state to state.
 
"Run its course" I could only hope lol that were the case with my situation. I thought it had, and I am sure that if this one is denied she will file yet another one probably under the fact lets just say I see her in Walmart and I glance at her, her version I glared at her and she feared for her life. I am serious this has gotten so far out of hand I just want her to go away and move on to someone else and just forget I exist I am trying to do that with her but she keeps getting these orders!!
 
Back to court we went today, after a very trying morning getting to the court house late because my vehicle broke down but still got there. My sister was there on time to let the judge know I was on my way. Which wasn't lookin good on my end! Almost didn't even go because I am so tired of fight this. I just want her to move on. Anyway with the help of my sister by my side coaching me on what questions I should question the other party was able to put holes in her accusations plus the fact that they didn't even fit under the definition by law of domestic abuse it was denied again. But she will again probably bring something else up and I will be here again.

Is there anything I can do to stop this from happening? She comes up with lies and files these and I keep having to go defend myself. Can I get an anti harassment order or something?
