Larceny 6 charge in CT... currently living in NJ

I'm not sure If this is in the right thread but I'd appreciate the help...

I'm supposed to be in court on Monday for my 2nd court date of a larceny 6 I got a couple months back. When I got the charges, I was addicted to heroin and homeless. I've since moved down to NJ and just started living and working with a friend. Financially its not possible for me to get to court Monday. If I have to, I can borrow the money and find a way there but I'm wondering if there is any way I can call the court and explain the situation in order to reschedule?

If you are supposed to be there Monday, I would say it is too late to attempt to blow this off. You might be successful but a court could look at it as if you knew you could not make it, then you should have contacted them long ago.

Waiting to the last minute and expecting the court to accept your excuse is never a good idea.

If I were you, I would do anything and everything in my power to get to court Monday. You knew you had this problem last week and quite possibly long before that. That is when you should have addressed it with the courts, not the weekend before you are supposed to be there Monday.

Your options:
1) Show up as ordered (either in person or by attorney - depends on the specifics of the appearance), or
2) The court will issue an ARREST WARRANT in your name.

I will most likely go but I'm wondering if it is possible that they won't reissue an arrest warrent. I know its late to be reschedualing. I'm wondering if I thought of a really good excuse, would it be likely for them to let it slide? Also... Who would I call? The Clerks office?

Okay, so now you admitting that you are going to make something (ANYTHING??) up and lie to the court??

If you are going to continue playing games in CRIMINAL court, you should only make TWO calls... to the following:
1) To a bail bond company. Go ahead and sign the papers early and schedule them coming to get you out.
2) To a GOOD local attorney, so that you can have him 'on call' for your call from jail.

I will assume this charge is a misdemeanor.If it is than the prosecutor is most likely a police officer for whichever police department arrested you. The way to re-schedule this would be to contact the police department and ask for the prosecuting officer. It is unlikely you will talk to him/her personally on your 1st call. Leave a message asking for a new date and a # they can contact you. Continue calling until you speak to the officer. If this charge is a felony this advice does not apply. goodluck.

In my state the prosecutor for misdemeanors is an officer designated by each department. Whichever town the crime occured, an officer from that dept. is the state rep. The only time that changes is when the charge is a felony and is in superior court. I believe the officers rank is sergeant. Although states differ, it is that way for at least 2 of the surrounding states. The others I am not sure about. Crap it is not. They are called "prosecuting officers".

You need to get your crystal ball fixed.... because you are NOT correct!!

The following comes from the Connecticut 'Division of Criminal Justice':

If OP doesn't show up in court, he'll be charged with a Failure to Appear.
Your drivel about the Prosecution's witness being able to excuse OP is ludicrous.
Even if, in some bizarre daveworld, your assumption is correct, the 'Prosecutor' will be in court Monday morning, not accepting calls from absent defendants, and s/he will simply add the charge of failure to appear. {OK, you think a cop sets the court's calendar and can just reset the court cases on the day of appearance/arraignment ... OK ...}

I said call and ask. I never said don't show up. I have no idea why you drew that conclusion. Court dates do get rescheduled. Whether or not he will get that opportunity is anyone's guess. Anyone can ask any question they want. Tobias2- If I was wrong about the officer prosecuting the case, than call the district court clerk and ask them what to do or whow to call. It goes w/out saying,but if you cannot reschedule and you do not show up than a warrant will be issued.
