Just for those of you who have never worked the night shift at a hotel, and I have, sometimes your only duty is to be on site. I worked the night shift at a small hotel where on our busiest night of the entire year, I might have five hours of work to do in an eight hour shift. In the off season, I might be finished with all my auditing duties by midnight (11-7 shift) and have nothing to do except be present in case a guest needed something, until it was time to start breakfast at 6:00. How do you think my post count got so high? ;) In the four years that I worked the night shift, I don't think there were more than two nights when I actually had eight hours of work to do in an eight hour shift, and on one of those nights we were having the worst blizzard in twenty years.

Having actually worked the job in question, I see nothing whatsoever unreasonable about the poster sitting down. I can assure you that there are no duties he will need to do standing up that he cannot do sitting down. None that would take more than a couple of minutes, that is (perhaps fetching a guest an extra blanket, for example). I see no reason why he should not expect pay for that time; he's still available to do anything that he needs to do.

Maybe it's just because his post is so long, but I'm not seeing where he's asking to do anything but sit, which is quite reasonable. It appears to be the manager who is insisting on "relieving" him.

CBG is correct. I was hired to work a 40 hr. shift we were not given a lunch break. For the past 7 yrs I have been working a straight 40 hrs. I am not asking to sit and do nothing for two hrs. I am suggesting that I work the operators station during that time. I would still be working just not at the front desk.

Yes my doctors note specifically states that I need to be able to sit for 2-4 hrs out of an 8 hrs shift. I am only requesting 2hrs. We use to sit during our shift but the new company that bought our hotel does not want us sitting at the desk.

If I were taking lunch I would not expect to get paid but I have not been taking a lunch break and my contract is for 40hrs. I can't afford to lose two hrs of pay five days a week. Since they do not want a chair at the desk anymore suggested I work the operators station because usually the bellman who is also the runner ( the one to get guest towels, blankets etc.) has to stay and answer the phone which means the guest have to wait or has no one to get their luggage. If I cover the phones then he is free to assist the guest. I am not trying to get out of work or get paid for doing nothing. I have made suggestions that will give me the two hrs I need and STILL perform a job that needs doing. I also suggested I learn to do the audit so that I can do that for two hrs out of the shift.

I would prefer to sit at the desk for those two hrs. but they do not want that so I am trying to work with them they just want to save money and have me take lunch or work extra hrs to cover the money I lost. Why should I have to do that. If I took a two hrs lunch then I would need to put in a 10hr day to keep the same pay. That is reasonable to you all? I can't help it if I get back pain when standing for long periods of time. I coverd that when I was interviewed and was told that we are allowed to sit now the rules are changing.

Sorry my post were so long. I know men like to just cut to the nitty gritty of the matter. I don't mean to be a pain, I just wanted to be sure I gave them every opportunity to assist me and to be sure I had a legal leg to stand on before I did anything.
