so if the doctor is docuemting everything in the childs records as he says he is...then we can have the records requested and they can stand? that is a load off of my mind.

We have been working with an attorney for a while, but keep getting told to do more documentation, that we don't have enough.

The report cards are telling as well. Behavior issues, grades. And the teachers have commented about mom's home activites. They state that mom doesn't help with homework, and just sends the papers back with notes that she didn't understand it and to just keep the child in from recess and explain it to them. Can we reqeust e-mails from the teacher to mom? And what about the homework journals and planners?
Dad has a Right to ALL his child's medical & educational records, regardless of whether he is the Custodial Parent or not. He need only request them all (& probably pay a copy fee).

Dad can file ALL those documents when he petitions for Emergency Custody. If further testimony is required, he'll have the time/opportunity to subpoena prior to the next hearing.

No you cannot get emails from Mom to teacher....If Dad has access to the homework journals/planners, then of course, he can copy & file those. (& serve Mom per rules & procedure).

Grades, Medical issues~ these are reasons to file for a change in custody. I can't guess what the attorney's opinion is...but if Dad doesn't feel like his attorney is working for HIM, it might be time to get a new one.
