The 10 days leave is only granted to same-sex couples who need to travel in order to be legally married. If they're already in NY, or IA, or MN, or any of the other states where they can be legally married, they're not granted the leave.
It's not prejudicial unless the traditional couples NEED to travel in order to be married. And, they don't.
