Divorce lawyer looked at the judgment and consulted with a title company to verify their requirements, and recommended a quit claim signed by both ex and his new wife and filed with the county, plus a signed promissory note between ex and I detailing my purchase of the house from him including minimum payment and contingency for failure to pay and/or death of either ex or me. This sounded good to me. Until...

I was informed this weekend that ex is no longer married, hasn't been for eight months, and apparently this is why he was so shady about having her sign the quit claim. They're still together but he did it so she wouldn't be saddled with his financial issues. Okay *shrugs* doesn't bother me, that's their business (hopefully).

So now waiting to hear from lawyer about whether his new ex still needs to sign the quit claim or if it complicates things further. *fingers crossed* lol

I would guess that if they are not married, then she would not need to sign anything.

Update - he produced his second divorce judgement and it specifies his second ex has no interest in the house he and I co-own, so she does not need to sign. *thumbs up*

A quit claim was subsequently signed and notarized by him, and taken to the county recorder of deeds by me; it is done. The promissory note has also been written and signed by both of us with a copy for each, and if all goes well I will have fully paid him in four years.
