Moving to Portland, Oregon from Los Angeles CA custody

I have been battling my soon to be ex for custody since January 2018, we settled on 50/50 custody and he moved to NYC, as of Monday the judge gave me 93/7 temporary custody from our ex parte until our hearing date on April 25rh. I’m now moving to Oregon in January. Can someone tell me how to transfer my case and then after transferring I will apply for child support. Do I transfer the case now or when I move? I already have my address.

You would need to establish residency in OR first. A general rule of thumb (although it can vary by state) is 6 months. Sometimes, you need to request one state to relinquish and the other to accept jurisdiction (this was the case when I moved from NY to NJ). Yes you need to request one state to relinquish and the other to accept. And it will take six months of living there. So quite frankly, California will keep jurisdiction through that hearing.

You have to follow the rules for relocation. Which means requesting to the court that you be able to move.

Be aware that you may not get a hearing date by then. You have to follow CA rules for service of Dad, which are likely at least 30 days....

I was so sure the laws were to help the kids. My husband makes $250,000 per year plus $150k nines. I make no money. He moved to NYC for his cushy job and I’m in CA with rent of $2200 and applied for SS disability because I have lupus and kidney disease and I have to ask for permission to move somewhere that’s more livable? I won’t make it to pay any more rent after January.

I have 93/7 and he’s living his cushy life in NYC

It’s just not fair.

How are we suppose to do anything in life to make our kids have a better life if we are just tied down. Makes nonsense.

No, I didn’t know!
We had mediation on the 28th of November which he didn’t show up and mediation rescheduled it for the 15th of January to give him ample time. Which meant our court custody and child support would have been on the 11th of December but because we didn’t go to mediation, it was changed to April 25th. Now because we don’t have court until the 25th of April, he is stopping support. And yes, i just decided i finally needed to move since i can no longer afford it, just as he decided on October 6th or that’s when he told me, he was moving on Sunday the next day to NYC.

When you health immediately changes which you can’t predict with systemic lupus, when your organs do what they want. You can’t make plans. You can’t work as you use to work. You can’t tell your multiple myeloma now is not a good time because you have a 8 year old daughter you need to raise. I have been a mom with no job for 8 years and when we separated for a year I worked grub hub and Instacart and Uber to make ends meet without a dollar from him with his legal maneuvering. Then after working 50 or so hours a week my illness kicked in from every area so I’m unable to work. So yes some things just happen.

Wow, I wasn’t asking to get mental support but I didn’t think I would be torn apart while asking for some legal advise. It’s not like I’m rolling in dough and want free legal advise because I’m a free loader. Thanks again for your first answer it was helpful

Given that he's moved, you can likely move yourself. HOWEVER, the law does require you to follow the mentioned steps. You're still going to have to have your CA hearing - you may or may not be able to arrange telephonic appearance or to simply be represented by a lawyer. But, you wanted to know what you're required to do, legally, and that's what we shared with you. Sorry if you didn't want to hear that...
