California my 17 yr old daughter received a DUI bac.10 No license?
What will happen in court?
She lied to me and said she was spending the night at a friends house. Instead she went to a party at a local campgrounds. She was driving to the store in a friends car. Was speeding and had her hi beams on. She was released the same night in my custody. I am so upset with her.This is going to cost a lot of money.and now she won't be able to get her license. I don't know if I can afford a lawyer or if I really need to. Any advice?

Say good-bye to her. Find out the "visiting hours" - - after you've spent about $15,000.00.

There may not be much even a DUI attorney can do for her.

She will likely be hit with a license suspension, heavy fines, alcohol counseling, and community service - plus a couple year's worth of probation.

If I were you, I would make sure you track every penny she is costing you and see that she pays you back every thin dime.

Others here may provide a more detailed description of the likely or possible punishments.

The reality is that she is not likely to spend any time in Juvenile Hall. If she does, it will likely be only a few days. I have yet to see any underage, juvenile DUIs spend time in Juvenile Hall for a first offense and I have arrested more than a few. That is not to say that it CANNOT happen, only that it is not likely to happen.

It is always a good idea to consult an attorney prior to any agreement. Paying top dollar for a primo DUI attorney probably is no tnecessary in this case, but it is a decision you will have to make.

Is this the first time she has lied to you or the first time she got caught by the police?
Instead she went to a party at a local campgrounds.
She is a senior in high school, it is spring so she is going to go to as many parties as she can find until school is out and during the summer. I had a neighbor who went to such a party and he was a passenger in the car after a drinking party. They pulled out of the parking lot and into a stand of trees before her could buckle his seatbelt, he was killed instantly, his body shreded by the windshield his bones chrushed. YOU are lucky she was caught, it may have saved her life!

Why didn't you let her sit there over night so the seriousness of her actions would have some time to sink in?

This is going to cost a lot of money
let her plead guilty and ask for a diversion program and get her into substance abuse treatment and support groups. Make her work to pay all the fines in addition to what you plan to do as punishment for her actions.

getting her liscense is the least of your worries and at least you can point your finger at her responsibility for breaking the law which she knew she was doing when she consumed alcohol and drove a car without a liscense. Time for tough love, 3 hots and a cot until she is an adult or under your roof if she stays longer. Be sure to establish a contract for behavior and charge her rent once she turns 18, it is one way to teach adult responsibility.

As an FYI, most counties in CA don't have the room in Juvenile Hall for misdemeanants so they encourage the police to release to parents, or, they will do it themselves. Plus, they do not want to adopt the responsibility for the medical issues that might arise from being drunk so very often they won't accept the booking until after a medical clearance, and the police department doesn't want to PAY for the medical bill, so they release to a parent.

Ideally, a stay in JH for a weekend would be a great thing. But even in the biggest counties in the state there are too few beds available and most criminal kids get to go home. And with the state closing juvenile facilities and programs to save money, the options are getting fewer. There are ideas being floated that would close most or all CYA facilities as well.

She wasn't taken to jail. The CHP Officer called me and told me that I could pick her up. I'm sure she has lied to me before she is 17!

IAAL wasn't being funny and it could easily cost $15,000.
The Automobile Club of Southern California (AAA) has an article entitled "You Drink You Lose" http://www.aaa-calif.com/members/corpinfo/you_lose.asp on the costs related to a conviction for driving under the influence (DUI) which can easily exceed $10,000.00 in the first year. Include everything else such as the increased insurance costs, interlock devices, counseling**************

I think every high school has this happen. It seems like we had one each year for about 4 years. One almost identical to what you describe here.

OP: watch out for the graduation after parties, they can kill ya.
