My account suspended on ebay=FRAUD??

I got in a tiff with a buyer that we couldn't resolve. He accused me of fraud. As it turns out, he somehow filed a fraud claim against me on ebay. I got an email from ebay yesterday saying that "since you didn't respond the judgement was defaulted to the buyer." This is very odd considering I NEVER got an email from ebay that I saw. i wrote them back, but knowing ebay I'll never hear back from them.

My question is, does that hurt me and help him legally if he tries to sue me that my account was suspended for "fraud"? I wish I'd have gotten the email from ebay because there's no way he would have won that claim.

Okay, first thing, is your account really suspended? Do you see Not A Registered User next to your ID on your feedback page? If not, check your My Messages in your My Ebay for any messages matching the email you received. This could be a spoof email which tries to get you to log in through the provided link in order to record your passoword and hack into your Ebay account.

I've not heard of Ebay suspending a seller for fraud on a single buyer's word like that. It would almost have to be a rash of complaints from many buyers. OR, you could have been accused of shill bidding which Ebay would suspend you for immediately.

If you find that you really are suspended you can write to Ebay through the Contact Us link. It may take several days for them to read and reply. Most users that appeal their suspensions are allowed back on if it is the first time they have been suspended and IF the offense is not identifiable shilling or repeated complaints.

Yes it is - I can't even log in, I get a suspension message :(

I just don't get why I never saw an email from them. And according to their own email, the reason i was suspened was because I didn't reply to the claim so it defaulted to the buyer.

Also any idea if this hurts me in court if the guy tries to sue me?

If you get sued, anything negative or not in your favor can hurt and can be used against you in a civil suit.

I'm still surprised that you got suspended for a 1st offense of any nature unless it was shilling.

Try the Contact Us link anyway. Also, see if you can use the Live Help button without logging on. You may not have to actually log onto Ebay in order to use either link. I can search Ebay as a Guest without logging on with an ID. Just need the ID in order to bid or look at completed auctions.

Unless you are a Powerseller, there is not a phone number to contact a person on the telephone. I've always disliked that about Ebay.

I was thinking, if this comes up in court as a worst-case scenario, I'll print the email showing that the reason they did it was not because I frauded anyone, but rather because I failed to respond to their email.

Perhaps it came up as junk mail, did you check there?

My bulk mail has already been deleted on the day they said they sent me an email (Mar 17).

What are the legal ramifications of ebay suspending my account that this guy can use against me?

Not sure why it would, when all other ebay messages have been received in the past.

For the same reason that about 50% of the time a newsletter I subscribe to is received in my inbox, and the other 50% in my junk box - because cyberspace is inconsistant.

Shilling is a form of fraud. It is essentially when a seller uses another ID (or ID's) to bid his own auctions up. The shiller is not intending to win the auction. If he does manage to outbid the current proxy, he will cancel his last bid after the high proxy is uncovered, then bid again just under it.

I don't think the Ebay suspension alone would harm you in court unless someone from Ebay showed up to testify against you. Unlikely. However, the Ebay suspension coupled with one or more other instances of fact against you would serve to strengthen the opposing case.

You do not give details of the problem you had with the bidder so it would be hard for anyone to give additional insight without knowing a little more of the circumstances.
 
I heard back from them. They said it's final, I told them I had NO reason to ignore the email and that it shouldn't be "final" simply because I didn't see the email and that I should be able to respond to this complaint against me. So far, they want me to pay $200 to reinstate, which i will never do; I haven't done anything wrong and honored my auction to the T. I'm very, very upset and angry about this. I'll become a spokesperson against ebay for the rest of my life because of this. I just can't believe this happened to me. How incredibly unjust. Guilty until proven innocent. :mad:

Have you been in contact with the buyer and I take it that you were the seller on e-bay is this correct! what was the details? why didn't you send the mercandise to the buyer, why did this get out of hand? Explain because like in the other responses it's unclear?

One other thing, why did he file a fruad claim against you! What exactly did you do to deserve this! Now let's be honest about this, remember there's always TWO sides to a book! just not one side?

What happened was, I sold an item. He assumed the item was a higher model than what it actually was, and made assumptions about the language in my auction that were incorrect (for example I used a verb, and he interpreted it as an acronym). So he overpaid by $600 and I told him all sales were final.

I never received any emails from ebay. I think that was by design.
