The problem here is that for the OP to make the case over the wine issue, the child would have to testify. Even if we assume that a court would say that a 9 year-old is a competent witness (and that is not a given considering how young kids can exaggerate things or treat their imagination as real) I would say it is not a great idea to put the child in the position of testifying against her own mother over something like a bit of wine. Parents need to sometimes take a step back in their battles with their exes to consider the position they put the kids in while waging those battles.Not in PA, apparently.
I still think talking to Mom first is the best course of action. For all we know, it was a sip, one time. Kids do sometimes inflate things.
