I still think talking to Mom first is the best course of action. For all we know, it was a sip, one time. Kids do sometimes inflate things.
The problem here is that for the OP to make the case over the wine issue, the child would have to testify. Even if we assume that a court would say that a 9 year-old is a competent witness (and that is not a given considering how young kids can exaggerate things or treat their imagination as real) I would say it is not a great idea to put the child in the position of testifying against her own mother over something like a bit of wine. Parents need to sometimes take a step back in their battles with their exes to consider the position they put the kids in while waging those battles.
