Thanks once again for sharing your opinion that I am qualified as head of family as I am the only person in my home who makes income from my job, and my husband has no income for the last several years.
I am sorry for coming back as I request your opinion as I forgot to share earlier. My husband has some land on his name (which he purchased far before the lawsuit which I lost) for many years but that land never produced any income (and also will not produce any income). He has also few thousands of dollars in his personal bank account for several years, and that money produces less than 100 dollars per year. Will this land ownership of my husband, or money in his bank account, invalidate or negatively affect my head of family status?
The law is:
http://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0200-0299/0222/Sections/0222.11.html
222.11 (c) “Head of family” includes any natural person who is providing more than one-half of the support for a child or other dependent.
222.11 (2)(b) Disposable earnings of a head of a family, which are greater than $750 a week, may not be attached or garnished unless such person has agreed otherwise in writing.
