Dont u know everytime a kid gets caught doing something its always the first time...how many times have u heard a kid say about time i got caught i have been doing this for months...

Clear up a few minutes in your day to make time to turn the key to box holding narcotics...

The more i read this the more questions i have....didn't understand the seriousness of medication.....you did not educate him about the meds???? Thats what u wrote...u said this is a 14 year old smart kid and he was not explained the seriousness of his meds by u or the doctor?????

Got news for u.....he knew exactly what he was doing and should be held accountable for this....stop making excuses for him and urself....he doesn't need to be flogged in town square however he needs to accept what consequences are dealt him....and apoligize to him for your slack off....

Whattodob's role in contributing to her son's actions will, no doubt, be investigated and her son will, no doubt, be punished adequately by the school and the court for what he did.

Whattodob, you may want to check out MCL 333.7401 et seq to see what your son faces on the criminal side. My feeling is he will be put on probation, have community service hours ordered, will have a screening and assessment, have drug education classes, and have fines. He could, but probably won't, have jail time.

You and your son may also face legal actions brought against him by the parents of any child to whom he distributed the drugs.

I emphasize, once again, the need for your son to have an attorney.

Under the IDEA Amendments of 1997 (20 USC 1400 et seq), under §1415 (k)(4), before school personnel can suspend or expel a student who has a disability and who violates a school policy, the school must determine whether or not the student's conduct is related to the disability. This should be done within 10 days of the incident by your son's IEP team. The review must ensure that your son's disability (and, like slwx, I am assuming he has ADHD or a related disability) did not impair his ability to understand the impact and consequences of his behavior. You should discuss with the attorney you see whether the school has followed the proper procedures.
Maybe I am misunderstanding your point here, but are you trying to suggest that if the disability (ADHD) is related to the offense (multiple drug related offenses, actually), then the school is prohibited from acting?

The school is not prohibited from acting, but they must follow certain procedures prior to acting, and the actions they take may have to be different (ie. a recommendation that there be an adjustment in his medications, parapro support, counseling, instead of, say, expulsion).

That said, however, I don't see here that he will escape punishment (suspension, alternative school, probation, civil actions) because of ADHD (or whatever his disability). A drug offense would be looked at differently than a violent outburst or a minor act of violence (shoving, kicking). It really depends on what, exactly, his disability is, how severe, and how his "team" judges his ability to control his actions and think through the consequences of his actions, I guess.

All I know for sure is that an attorney who specializes in special education issues should be consulted.

It appears to me that the school is taking this as seriously as it deserves to be taken. Their report to the police is as it should have been. The police appear to be handling the matter in the proper way. There is no indication, from what has been posted here, that any of the boy's rights have been violated.

However, there are certain procedural steps that need to be taken under these particular circumstances to ensure that this boy DOES have his legal rights protected. An attorney is necessary for this reason, and for the fact that this boy is facing criminal charges.

The boy will not escape punishment entirely for conduct that could have easily resulted in the death or injury of another student. Nor should he.

I agree, as usual, with quincy on this.

The moment you start adding an "unless" to providing illegal drugs at school, you have started down the proverbial slippery slope.

The child IS a criminal.

my son was prescribed adderall XR -- i broke the law and took one because i wanted to see what kind of affect it would have on him.
That was....not bright, to say the least. You could not possibly know what effect a medication will have on SOMEONE ELSE by taking it yourself. Particularly with ADHD medication, it's going to have a different effect on someone WITH the disorder as someone without.

Why would I have come to this site if not for legal help? I wanted to know what we were facing nothing more. I wanted to know what we would face legally, opinions about medicine cabinets and drug dealing... Where do you people get off? No one asked me a question? You people are making it up as you go. I am sure some of you will believe I am a crack-head by the end of this post, it's whatever you want it to be.
I want to thank the folks who actually READ & ANSWERED my questions and for their professionalism:) I have already had the IEP... etc., we are now waiting to meet with the school board. When I received the letter from the court yesterday I spent hours trying to find information or similar case files to get an idea of what we were facing, with no luck.
My son has Asperger's Syndrome, its been a lot of work but I never let him use this as an excuse. Accommodations are made for school work and testing, however I have him classified ADHD, because classifying him as Autistic will limit his options for the future.
His medication does not affect him the way it would a "normal" child. Was he aware of what the pills mean to "normal" kids? He has taken them for 6-7 years now, wasn't at the top of my conversation list. The first time he has done it or gotten caught? I knew the morning he left for school they counted short. Too late for my problem, I have busted my behind and sacrificed, never asking for help or sympathy. For A-holes on here who think they know me, you're textbook.

You're the same people that think fat people are fat because they are lazy or eat fast food all the time, couldn't be genetics? If my kid screws up its because he's a little ******* and I am out at the bar every night while my kid runs the streets.

I live in a beautiful house in a nice sub, working on a second degree... I didn't get boyscouts, baseball or soccer; instead I got multiple dr. appts., blood tests and shrinks twice, my older son is an Aspie also. I do not want you to feel sorry for me? But I am not going to throw my son under the bus because you call him a drug dealer or say "mommy needs classes", screw you.

I am done, again I sincerely thank the folks who stayed on point, you know which ones you are:) I really do appreciate your professionalism and you were very helpful.

For the others, I am not to re-reading or editing this before I post it so there are PROLLY mistakes, run-ons and ramblings-ons and incoherency at times. If you don't get it so be it you never will. Educate yourselves on Asperger's maybe you will be less judgmental. You might want to talk amongst yourselves about the way you respond to people asking for help free or not most of you were out of line with giving your opinion and it had grown tiresome.
P.S. cyjeff, you are a moron, proof that common sense isn't so common.
