Here's the thing: Your child deserves to be supported financially by you REGARDLESS of your choices. If you were earning enough to substantiate that amount, then you should be paying that amount regardless of the fact that you are NOW in school and working part time. Have you ever earned more per hour than what you are earning at Kohl's? If so, why did you leave that job? How much of your current order is arrears? How much of your current order is based on full time earnings at your prior job before you decided to go to school? Why -- and when -- did you leave your prior job? Why did you decide to go to school?


I decided to goto school in order to be able to get a good job. I got laid off from my old job.

I do not...have not...ever made enough money to pay $548.00 per month. It is outside the guidelines.

I did file with the DOR a request for support order review....they agreed with me and sent a petition to the court....to lower my payments...that's what this hearing was for...yet the hearing officer still did not lower my payments to the amount suggested by the DOR based on my financial statement.

Hello all,

I found this site while looking on the web for help. I just had a hearing with a DOR support hearing officer. I filed for a support order review a few months back...and finally had the hearing today. In the support order review I filed out the financial statement and sent it to the DOR, they in turn agreed my support should be lowered so they sent a petition to the court in order to have it lowered, the father sent in an objection and caused the hearing. Today in the hearing the DOR hearing officer said that she finds no reason to lower the support order....that makes no sense to me...the petition filed by the DOR states that the support should be lowered based on my current financial state.

I can not afford to pay the amount the are saying I need to pay...I will not be able to support myself and my older son.

She did say I can file an objection...can someone please tell me what steps I need to do in order to file an objection..please I don't know what to do...and can not afford an attorney right now.

Please tell us whether or not that amount includes arrears.
$3500.00 in arrears....I pay $548.00 per month plus $111.00 in arrears.

The guideline that was submitted by the DOR is based on a min wage job. I only make $7.85 per hour now. I am trying to apply to other places to get a full time job. I even called my school and told tem I may need to take a leave.

When he was paying me support he only paid $120.00 per month and he made more then me....I just don't know anymore what to do.


Also...I never made enough money to have to pay $548.00 per month.

Yes I am working and going to school.

I started working in Kohls and just called them today to see if they have a full time opening.


Can you give me any advice where I can find info on how to file an objection?
This is your problem. you may need to quit school.

I am going to do that for now. Perhaps go back to school at night after work.

I have no problem paying support, but I cant pay what I don't have.

I can only make so much money...so I will do the best I can do.

Yes..I was young and stupid. But a good thing came from it...my son. He is 12 now...he lives with me and sees his dad a couple of times per year. His dad is in the Navy..has been since a year after our son was born.

They had to have given a reason not to have it lowered. What was that reason in court? What all was said while you were there? Are you working full or part time? If you work fulltime, and are a student, then as far as I know, that shouldn't count against you. Need more information. You're going to have to educate yourself and maybe at least get a consultation with a local attorney. Also, go to the court house and ask the clerk what you need to fill out to appeal. There's normally a time limit to do this in. No one is going to help you, and you'll usually will be put on the defensive when ever you talk about having payments lowered even if and when it deserves to be. Either way, I believe you have to be leaving something out. You couldn't have walked into court, the DOR hearing officer said not to lower it w/o giving a reason, and you turned right around and walked out...

A) She already said she worked part time.
B) A clerk can't tell her ANYTHING as that would be practicing law without a license.

Also, go to the court house and ask the clerk what you need to fill out to appeal.
Excuse me but as I stated a clerk CAN tell her what forms she needs to get from the clerk to file an appeal.... I'm asking ChiGirl82 by the way...

Excuse you but NO the clerk cannot tell her what she needs to do. A clerk cannot give advice. The clerk will tell her to hire an attorney.
