What is the name of your state (only U.S. law)? PA

This evening is yet another sunday evening where my ex wife returned our son from weekend visitation with a strange unattractive smell. Sort of like in the area of body odor and/or moldy furniture.
1st off she to this day will not let me see her apartment because her boyfriend will not let me see it(such a dramatic couple, I have never shown any aggression towards their relationship, plus I have a partner as well). I told her it's none of his buisness and go somewhere else while I see the place if he has such a problem with me(never even spoke to me before) Although my attorney says I have every right to see it, im still trying to work with her without getting the law involved on this as I am getting more and more concerned. Im trying to ask her questions like what she is cooking that may cause it, ect...
Anyway what can I do if she doesnt give in? I really do not want to deny her overnight visitiation, but its looking I may have to go in that direction.

DON'T deny visitation. It's a court order and you would face contempt. Wait for senior members to advise you on the rest.

Under what authority or statute does your attorney believe you have the right to enter/inspect HER private home??????

I agree with COurt Clerk. You have NO RIGHT to demand to see her apartment.

Also, how old is your son?

Under what authority or statute do you believe i have NO RIGHT to ensure the quality of life of MY child? Did u not read the reasons for this?
Oh and in addition she was found guilty of neglect resulting from an investigation by DYFUS a year ago, so YES I am a bit concerned regarding the welfare of my child, even if it is something simple, as you obviously put it, regarding a smell. Ohhhhhhhhh of course you didnt know that.
Maybe ask questions rather then trying to make me look like some evil custodial parent trying to simply deny rights with this sarcastic"??????????????????????????????????????????????????????????" at the end of your statements? Everyone's situation is unique, dude. Please try not to generalize with me, or so not respond. Thank you

You have yet to answer my question. Under what LEGAL (as this is a legal website) authority to you or your attorney believe you have the right to enter/inspect her private home? I'm still waiting for the answer to that question without all the rest of that hyperbole.

You have the right to ensure the quality of life of your child. You don't have the right to enter or inspect her home without her consent.

See: trespassing (for one).

Watch your advice there, buddy.
There are many circumstances which can forfeit visitiation...court order or not.
Give me an instance where YOU can decide to forfeit visitation when not specifically worded in your court order. Make your answer legal, not what you feel/think. Back your answer up with statute.

I'll wait.

You're quickly going from Dumbhubby to just plain dumb.

I did not receive her consent which is why I posted this. I did not goto her door. Tresspassing? Again, did u read my post? And thank you for answering my question as I do have the right to ensure the quality of life. According to you I should open a case with family services rather then having her cooperate. A child should not be returned smelling and dirty without an explaination.

He stinks because he was playing and little boys stink. They come home smelling like all kinds of random things just because. If you feel the need to contact family services because your child stinks, go right on ahead. If the child stinks, give him a bath. Other than that, you and your attorney can both go pound sand with this, you have the right to inspect her home. No judge on earth will order her to let you in her home. Do yourself a favor and don't make yourself look so foolish and your attorney look so incompetent.

I did see ignorance. The minute I read your post.

Other than that, you don't get to decide who responds to what here. If you don't want to hear the answer, don't post the question.

Forfeiting visitation:
Under inflluence or drugs alchohol.
Good reason to believe to leave state/country without mutual consent.
Attempting to travel with child in car without child restraints.
Reason to believe child is in rooms full of tabacco smoke.
Good reason to believe child is not being washed/fed properly.
Child is not being treated as should. ( for example child has mild signs of autism and must be approached accordingy, and complaints from caregivers confirm this.)
Hey I can go on. And if u want to argue please go post in Womperroom

Seeing as if smoking is not illegal, and one's interpretation of washing and feeding properly is subjective, I'll ask again...

PROVIDE THE STATUTES.... NOT JUST YOUR THOUGHTS.

Oh, and if any of this is true, why haven't you yet denied visitation since you have good reason to believe that the child isn't being washed properly???? Where is the case law that supports your answer?

What???? There is none. Congratulations, you have officially earned your screen name.
