Doesnt the fact that I asked "am i receiving OT for this" and i was told, in writing, i'd be paid OT for my work, indicate I should be paid OT.

I mean i was told, in writing, what i'd be paid, only to have it changed later. Thats the same as my employer emailing me saying "your new rate of pay is $XXX" and then paying me a lower wage.

I never said im suing, people seem to have a very negative attitude here jumping to yell and curse and scream. Im not interested in people with a negative attitude, im simply here to envoke a discussion and see what others think and their experience. No reason to get nasty, totally uncalled for.

This is a legal board. We are here to provide general legal information. We are not here to rubber stamp your theories on what you should have received.

As a responder on another board says frequently, the law does not care even a little bit what we think. So even in the very unlikely event that you succeed in convincing every single person here that you are due the overtime, it would not change the fact that the law does not agree.

Unless you are prepared to show that you have a legally binding and enforceable contract that guarantees you overtime in this instance, you're not going to get it unless your employer chooses to give it to you. You will need a very good attorney to show that you have a legally binding and enforceable contract. You will have to pay that very good attorney. In the unlikely event that you succeed, you will be awarded one and one quarter hours of pay. That will not pay even a fraction of what you will owe the attorney.

So, just what do you think you will have gained?

I would say, as long as the person saying you would be paid OT has the authority to do so, you would be due the pay. Since you do not want to sue and the department of labor really doesn't care about this, you are stuck with speaking to management/hr about the issue and accepting the results.

There really is nothing else to say about the issue.

And who was yelling, cursing, screaming or getting nasty?

This is the wrong place if you were expecting a pat on the head and a "Yes, you are so right." (Not that either would get you anywhere.)
