Forms

The attorney has emailed me some forms to fill out, they are forms: Order to Show Cause (FL300) http://www.courtinfo.ca.gov/forms/fillable/fl300.pdf and Application for Order and Supporting Declaration (FL310) http://www.courtinfo.ca.gov/forms/fillable/fl310.pdf and to do my declarations on a blank piece of paper and attach it to FL310. Honest to God I have looked these over and have no idea what to fill out what boxes to check or anything. Where do they go if I ever get these filled out?

The attorney wants me to file for sole physical custody, child support, shared legal custody with him having visitation. The attorney has looked at the emails his wife/him have sent me and because of the threats/harassment, no cooperation, parental interference, his wife saying that I am not in my daughter's best interest, no nurturing of relationships, trying to ban me from our daughter's school, medical and dental decisions and so on that I will probablly get it. Is this the right thing though? What do you think a mediator or judge might say? Need your honest opinions please. I don't want to do something because it makes me mad I want to do what is in the best interest of our daughter and this is why I am so back and forth with what to do. Usually I am a good decission maker but find myself not sure what to do in this case.

Oh the memories.....I went through this so much with my X and his wife that the dentist got sick of dealing with them and said that we could not take my son there anymore. Hope you don't run into the same problem with your childs doctors. I talked the the pediatrician about it and showed them the custody order and they put a post it note on my son's file that no one was allowed info but dad and me, and that stepmom was not allowed to make appointments, have him treated, or have info.

I know really. It could happen. I did show them the custody order but they are not understanding. All this over flu shots, but it was a matter of time anyway.
 
No matter what your attorney advises its what you think is best. If you think leaving your custody plan the same thats fine but you should go to every dentist, dr and the school and tell them that any changes in anything go through you or your husband. I can see her picking them up or taking them to school but making decisions is uncool.

I understand what you are saying. I brought that up to the attorney and he said that he thinks a firm letter from him won't even be enough. My ex-husband, not husband as you put above....lol, or his wife not sure who wrote it because they sign it with both names said there will be no more co-parenting. My ex/his wife said they make all the decissions with our daughter because when my daughter is there that stepmom is her mom and will act as her mom. I have no problem with stepmom picking up or dropping off or even attending school activites.

I can see where he is coming from though. Serious non co-parenting is a huge problem for me & my ex. I took a class and she still hasnt. I even told her i would take it with her. But I think co-parenting is something your ex needs to do seriously. I understand theres an extra parent and maybe u have a husband now but no matter what stepmom thinks of you if she cares about your daughter she would screw around like this.
