Then you should have gotten a temporary registration (it's a pink tag with a number corresponding to the month it is good through) to place on the window. Usually they only give those for no more than 90 days. But, since you said you had a PNO (permit of non-operation) then the vehicle was NOT legally permitted on the street in California.

No. It's not a burglary for the reasons posted elsewhere. :rolleyes:

Though, in CA you CAN have a burglary of an automobile ... just not under these circumstances.

If YOU had gotten in to the vehicle and the doors had been unlocked (as they apparently were) then it might be theft - but not burglary.

Absolutely. The PNO means that it is NOT allowed on the street. If it is, and the registration os 6+ months in arrears, it is subject to impound.



If he is towing it, no permission is necessary pursuant to an inventory of the vehicle per agency policy.

Nothing whatsoever in this situation was illegal except for your allowing your son to drive a vehicle illegally (remember, you are the owner and if he had been in an accident YOU would have paid the fines and lawsuit) and your son for operations of an illegal vehicle.

Any way you try to spin this the two of you are the ONLY ones who are legally responsible in this situation.
ya ya ya whatever you say BUT #5 was wrong the wallet NEVER left the officers grimy hands, someone from their side was LYING in this town the cops are _ _ _ holes I never beleived it until i had to deal with them they are total jerks, but what do you care!!!

Did your son ever go to the department to retrieve the wallet? or to find out what they wanted?

It sounds like they were attempting to get him to come in so they could talk to him. And a ruse is a perfectly lawful and legitimate tactic. So they, apparently, did nothing wrong.

And the police are not paid to be Mr. or Miss Nice Guy, but to do a particular job. And almost every day someone is miffed who is at the receiving end of some form of enforcement - or does not like the answer they receive when they call the police.

Carl, the wallet was NEVER at the station, the officer had it the whole time, he gave it back to Jon when he was through doing his particular so called job, that's what has me so dang mad about the whole thing, they called me at home and told me that "someone" not them, had found the wallet, they didn't say where or give me any other info, after I hung up I thought about it for a second, (they did wake me up it was almost midnight) and then I called them back and asked them what did they mean by "someone" finding the wallet and where did they find the wallet, they said it was found in the glove box, NOW, I'm thinking wait a minute, the wallet was found in the truck, in the glove box, by someone, what right does someone have to enter someone vehicle and go through it only to find a wallet, and then turn it in to the police station they failed to tell me that they had Jon detained and were going to tow his truck a lack of communication lies here by none other than the DA-- cops ---holes in my book thank you and goodbye!!!!!!!

Okay ... so maybe he called his Dispatcher to get a number, the dispatcher called leaving a message but - unknown to the dispatcher - the officer had returned it to Jon. It wouldn't be the first time something like that happened.

And as for the "so-called" job comment, well, until or unless they change the vehicle code requiring vehicles to be registered when they are on the road, the officer WAS doing his job. And it's dangerous in that particular situation (in the driveway) - a friend of mine was shot in the head by a vehicle owner several years ago as he stood in the driveway waiting for a tow truck. So I doubt the officer was doing it for grins and giggles - we don't get paid by the tow or the ticket.

Maybe it was a foul-up, or maybe it was a ruse that had been attempted but then was not necessary. Who knows. I suppose yuo can always call and ask them.

Either way, there was nothing unlawful or improper done.

They don't have to tell you they have him detained. In fact, they may have no legal right to tell you until or unless the car was registered or owned by you and had been towed.

And if the cops are what you say they are - fine. But, they're still a call away whether you like them or not.
