Thanks everybody for comment. Please can you advice me any webpage in the USA which could possible evaluate documentation and evidence I would provide them with and provide free legal advice or representation based on shared profit. Maybe the case could be possible solved just by sending a letter to gas station chain or VISA with offer for out of court settlement.

What makes you think you'd be entitled to such an outlandish monetary award anyway? Because you're a foreigner? That band wasn't that good, my friend.

Kevil, in the USA there are lawyers who work on a contingent basis. What that means is they get paid only if they win. If you look in the local phone book you will find lawyers offering such services. Take your story to them and see if they wish to take on your case. If they are uninterested then your case has little value.

So, the merchant did their job. They are not required to attempt heroic methods to make your card work. If you had a problem, you should have called VISA immediately. Any legal argument you have against VISA went out the window with failure to mitigate. It could have been something as simple as a system outage, resolved by you making a phone call.


It was not this case. The card was accepted by the POS Terminal without any problems but just declined. If the problem is with the POS Terminal the clerk could use the imprinter or call the authorization center by phone to get authorization code for transaction. Note I am expert in data communication with deep knowledge of payment cards.

Having been a merchant with a contract with a merchant servicer (many times, over many years) I disagree.



It would be a fairly remote possibility that a very large merchant chain would program to refuse foreign credit cards. However, in that instance I do think that VISA would have an issue with it. Its a major part of their marketing that their cards are the most accepted, world wide.
I had a Visa debit card, which can also be used as a credit card, issued by a local bank in the next county. The bank headquarters are thirty seven miles from the store I where I was shopping. I had money in my account. When I ran my card as debit, it was declined. It happens sometimes. I ran it as credit, it went through. Maybe I should have sued Menards for mental anguish since my MIL was with me, and she griped at me for years about having a declined transaction, even though I did nothing wrong.

Ok, so maybe I'm just being cold as ice (although my wife claims I'm actually hot blooded), but unless I'm having double vision, this comment is a long, long way from home.

I realize it feels like the first time I am calling you out, but in my defense, it's been a blue morning, blue day and I've been in a bad mood.
