Sorry for the delay guys on finding the statute..my friend says there isn't one. According to the police report there are two items listed:
Driver A: Driver Inattentiveness
Driver A: Tailgating
The guy who rolled into us is listed as being Driver A.
My friend's insurance is telling him that they are invoking the doctrine of compartive responsibility or something like that. Sounds like both folks are gonna get the shaft.
