NC. We called our lawyer today and he basically told us we will be held responsible for the year he lived with us because we did not notify the court. We asked him about a modification order and he told us to send her a statement in writting that he doesn't have a job and state how much he will be paying and said that once DH got a job to call him back and he would have it modified in court. I am confused by this - sending her a letter, what kind of letter? Won't DH still be responsible for the full payment ordered?

I say forget the letter and find another attorney. A judge won't care if you sent her a letter saying the DH was jobless. He will still be responsible for the support. You need to fight this now, not later.

Like Icollins said, forget the letter, it will do nothing. Has she filed for the back support or is it just a threat? If so, your answer can be a modification, also, get the childs school records to show where he had been living. No one can tell you which way the judge will rule. Could be he'll allow a temporary modification, or he could tell him to get a job. The same with the back support. File for modification immediately!!! You don't need a lawyer to do so.
