Jilly the thing with leases that other tenants and no pet clauses is that a LL can choose to let one tenant have a dog and deny others the same ability just like cigarette smoking there are some landlords who have allowed older smoking tenants to stay on but newer tenants leases don't allow smoking. As to any further communications with the actual landlord use letters written on real paper sent via certificate of mailing or confirmed mail delivery ( those are the two lowest cost means to give you a receipt showing to whom mail was sent , staple receipt to your copy of the letters and save as if you were going to need it for court so you will have a paper trail proving you have complained about it.
 


Yes that would be her next step since her first complaint was to landlord by phone. He was completely understanding but now the barking is escalating again. For a while the situation improved, the dog was still outside but much quieter. Now sure how the supers accomplished that. She’s just worried about repercussions from the super. Feel bad for her that the super obviously hid the dog and no mention of dog until after the lease was signed and now she’s the ‘bad guy.’ I wish I could post audio on here the barking is unbelievable and I guess because it’s in a small alleyway closed on three sides the sound echoes and can be heard throughout her apt as if the dog was in her apt. She’s is not a complainer,she’s 25 and nothing bothers her but this is beyond bearable for her.

Poor dog! Being left outside all the time in all kinds of weather, without adequate shelter. Can't fault the dog for barking. I vote as well for calling animal control or the SPCA, as it sounds like the dog is being neglected.
 
Go to the local PD and file a complaint under the NYC noise control act.
Title 24, chapter 2

§ 24-203 General definitions.
When used in the New York city noise control code the following terms shall have the following meanings:
(62) Unreasonable noise means any excessive or unusually loud sound that disturbs the peace, comfort or repose of a reasonable person of normal sensitivities, injures or endangers the health or safety of a reasonable person of normal sensitivities or which causes injury to plant or animal life, or damage to property or business.

Do not fault the dog at all! Last winter we had some brutal weather like temps in teens and they left the dog outside then too! The dog is huge and I don’t even think he lives in their apt but another room in basement. Checking 311 site there are numerous complaints re barking dog and animal cruelty going back over two years. It’s all about the owners. She’s gonna write to the LL again and see what happens.
