You should motion to strike the attnys fees - handle this today - it will get you in front of the judge on a winning side. While it may be SOP to ask for attnys fees; its also std practice to get these things striken from the answer. Otherwise, you must address this (and any other affirmative defenses) in your reply brief. See practice rule 12 ... if you dont understand any answer, you can ask them to clarify the answer as well.
