The argument could be made that yes it matters. Though the argument could be made that you are available. So it is POSSIBLE that you could be found in contempt.

I did not know that. I'll have her call for permission from now on.

My real issue is him not taking or using parenting time. He takes her when convenient then pawns her off on cf or gma. When I could be with her. Drives me up the wall.

He can send the child to grandma's. And he doesn't have to exercise all of his time. You need to realize you are NOT in control of this situation.

He can do whatever he wants on his time. I'm only referring to when he is gone in regard to Rofr. The last bit was a vent. You know? Why fight so hard for visitation if you're not going to use it? Just thinking out loud. Sometimes seems to me he uses visitation as control bit that's neither here nor there.

Yup...ANY TIME she isn't in your care for over 3:59 min, Dad should have the ROFR.
