OK to charge a toll for private road users?

We have a private road with a road maintenance agreement for the original five lots to equally share the cost of maintaining the road. A sixth lot began using the road and never got added to the maintenance agreement. The sixth lot then got subdivided into thirteen smaller lots with additional private roads that feed onto the original private road. To make matters worse we also have a number of other houses that are choosing to use our private road because it is a shorter route to the main highway. We have a mess with over twenty homes that are using the road without any responsibility to maintain it. Is it possible to force the houses that must use the road to sign a new road maintenance agreement and is it possible to charge a toll (usage fee) for those people who are choosing to use it instead of the public road that they are supposed to use?
