I really envy you. When I make an assertion, I always feel this uncontrollable urge to explain it logically. You, on the other hand, can spew out whatever inane thought you come up with, not back it up with any kind of reasoning, and be completely comfortable with that. Must be nice.

Counting posts bye strangers does what for you? Does it change YOUR problem? Grow up, reality is a kick in the face.

I suspect the people leaving flippant responses all fall into one of three categories: failed lawyers; people who hold a law degree but work outside the field; and failed law students. While you might claim to be legal experts, the fact remains: If you were as knowlegable as you claim to be, you'd be out assisting clients and making money, not devoting your existence to a message board. I think you guys were dealt a cruel hand by the real world and/or law school, and now feel the need to relay that cruelty to others, of course hiding behind the interenet's anonymity. All of this "pro bono" work you guys are doing is no more than a spiteful attack on the world that spurned your 'legal genius'. But, whatever. You're not gonna hijack my thread. The floor is still open to anyone who's ready to respond in a substantive manner. Also, I wonder why seniorjudge hasn't weighed in on this yet. I'd like to know his opinion on the matter.

I just saw this thread.

Doesn't matter why she stopped. I've braked midblock because I saw a ball bouncing into the street that looked like it had a kid following behind. The child DID stop short of the road- but if they hadn't, at least I had been alert enough to stop in time. I've also braked midblock because I saw a dog headed into my path. On another occassion, I just missed a deer at dusk.

Point is - an alert driver should not be too close to stop - no matter what. Especially on a city street. Mister - bottom line is, if you hit her from behind, YOU are at fault.

Amen! Even if the lady had a very good reason to hit her brakes, this guy would have rear-ended her anyway.
