I live in Idaho, but my injury on the job occured in New York. The injury was supposedly corrected with surgery in December of 2004, but I have had problems that have persisted ever since. I could only find one orthopedic in the state, that was willing to accept out of state comp, but he isn't a true shoulder specialist. He sent me for an mri, and a number of problems (that seemingly were missed by the original surgeon) were found, but he wants me to see a shoulder specialist. I cannot seem to find one that will even accept out of state comp, for a consult, so if more surgery is needed, I expect things would get much more difficult. What are my options at this point? I assume I have to choose to either foot the bills locally, then go after my former employer when a settlement hearing is called or fly back to New York, for not only a consult, but also any pending treatment, then try to get reimbursment for the travel costs at the settlement hearing? I really can't afford to do either option where I pay considerable upfront costs, but I do want the pain and case to end, as soon as, possible. Please offer any suggestions that you may have.
